The Office of the Treasury Counsel provides legal and policy advice to the Secretary to the Treasury and other senior officers in the Ministry of Finance and National Planning.
The Key result areas of the Office of the Treasury Counsel in 2022 include:
- Negotiations: negotiation of domestic and international financing and grant agreements, and contracts on behalf of the Government, in order to obtain favourable terms;
- Legal Advice and Opinions: provision of legal advice and opinions on domestic and international contracts and other related matters to facilitate informed decision making;
- Agreement and Contract Analysis: scrutiny of agreements and contracts prepared by other parties.
- Draft Agreements and Contracts: preparation and drafting of domestic and international agreements and contracts, in order to secure conformity with domestic and international laws, and to secure the interest of Government.
- Layman’s Draft Legislation: preparation of layman’s draft bills and statutory instruments in collaboration with the relevant parties and the Ministry responsible for Justice, in order to facilitate the provision of an appropriate legal framework.
- Tax Advice: preparation of appropriate legal advice on taxation and tax related matters, in order to ensure conformity with domestic and international tax laws, standards and best practices.
- Agreement Depository: collation and management of all domestic and international financing agreements entered into by the Government through the Ministry responsible for finance onto a database and keeping hard copies
- Litigation Documents: preparation of documents and other evidence to assist the Attorney-General’s chambers in litigation matters that involve the Ministry responsible for Finance, and in coordination with the relevant offices.
